Terms & Conditions

  1. Information on how to claim and qualify for the offer forms part of these Terms & Conditions. Participation in this promotion is deemed acceptance of these Terms & Conditions. This offer does not apply in conjunction with any other promotional or trial offer.
  2. The offer is only open to New Zealand residents.
  3. Employees (and their immediate families) of KitchenAid Australia Pty Ltd, participating stores and their employees and agencies associated with this offer are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  4. The offer commences on 20.02.2017 and ends for purchases at close of business on 18.03.2017. (”Promotional Period”). All claims must be received by 11.59pm AEST on 01.04.2017.
  5. To be eligible to claim, individuals must purchase an eligible KitchenAid product from any authorised stockist during the promotional period. Claimants will be eligible to receive the cash back amount that corresponds to the eligible product model purchased. Eligible KitchenAid product models are Artisan® Mini Stand Mixer KSM3311 ( $100 Cashback) and Pro Line® Blender ($200 cashback).
  6. To claim their specified cash back, individuals must, during the Promotional Period (a) purchase either the Artisan® Mini Stand Mixer KSM3311 ( $100 Cashback) or Pro Line® Blender ($200 cashback) from authorised stockists (b) go to the online claim form located at www.kitchenaid.co.nz and input the requested details including a clear, scanned copy or photograph of the purchase receipt. All entries must be received by 11.59pm AEST on 01.04.2017 to be eligible for the nominated cashback value.
  7. Incomplete, indecipherable or illegible claims will be deemed invalid. Multiple claims permitted, subject to the following (a) one (1) claim permitted per the specified purchase requirement and (b) each claim must be submitted separately and in accordance with claim requirements. The promoter’s decision is final and no correspondence will be entered into.
  8. The Promoter reserves the right, at any stage, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms & Conditions or who tampers with the claim process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  9. Claimants must retain their original store purchase receipt from the Eligible Product as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of the claimant’s claim and forfeiture of any right to the offer. The purchase receipt must clearly specify the store of purchase and that the Eligible Product was purchased, and paid in full, during the Promotional Period but prior to claiming.
  10. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate. No responsibility will be accepted by the Promoter for late, lost or misdirected claims.
  11. Payment of the cash back amount will be made within 28 days of receipt of the correctly completed online claim and only by Electronic Funds Transfer (EFT). The claimant must ensure that all details provided for the payment of the cash back amount are correct. The claimant is responsible for providing full and accurate bank account details and KitchenAid Australia Pty Ltd will not be responsible for any cost associated in locating these monies.
  12. Any costs incurred by the claimant associated with accessing the Internet, claiming the cash back or telephone enquiries in relation to the offer are the sole discretion of the claimant.
  13. The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the claimant’s ability to participate in the offer.
  14. Nothing in these Terms & Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (‘Non Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees.
  15. KitchenAid Australia Pty Ltd (ACN 601363419) (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
  16. Except for any liability that cannot by law be excluded, including the Non Excludable Guarantees, the Promoter, KitchenAid Australia Pty Ltd (including their related bodies corporate, respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of; (a) any technical difficulties or equipment malfunction (whether or not under the promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or claimant.
  17. The Promoter collects personal information ("PI") in order to conduct the offer and may, for this purpose, disclose PI to third parties, including but not limited to agents, contractors, service providers and offer suppliers. Claim is conditional on providing this PI. In addition to any uses that may be outlined in the Promoter’s Privacy Policy, by submitting a claim, each claimant then consents to the information they submit, being entered into a database of the Promoter and for this information to be used, for an indefinite period, unless otherwise advised, for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. All personal details of the claimant will be stored by the Promoter and are subject to the Promoter’s privacy policy, see https://kitchenaid.com.au/privacy-policy. The Promoter may also transfer PI to entities outside Australia however will ensure any such entities will treat PI in accordance with the Promoter’s Privacy Policy. The Promoter’s Privacy Policy also contains information about how Claimants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter.
